Ummm... not even sure where to begin... I just received information from my attorney that my exes attorney filed for a continuance due to an emergency hearing that she has to be at. I personally call BS on that b/c my ex and his attorney have been difficult throughout this whole process. So instead of going to court on Thursday as originally planned, the date has been changed to August 4th. Which means even longer that GCP and I will be apart and my family continues to stay seperated. It's taking me forever to type this b/c I can't see straight at the moment. I'm so disheartened and don't know what to think right now. Plus, I have an abcess in my bottom jaw and the first antibiotic did not work so they had to put me on a stronger one. I'm not allowed to drink alcohol or even use mouthwash with alcohol in it b/c it will send me to the ER... oiiiiii.......

All I'm asking is for LOTS of prayers please!!! .

All I can say is hope a big hurrican comes along this year and washes away the whole state!

I hate to bing bad news but no matter what you do it's going to be a battle! There is not a Judge in that state that will allow their "KIDS" to leave unless both parents leave.

Their laws are stupid! I have been fighting for 9 years with my EX, the lawyers, judges etc.... My child has been living in a messed up home all that time. Finally, she is coming home to me after a 9 year battle and 20 thousand dollars! But still all they will give me is temporary custody! This is their way of trying to keep control.

In my case the Judge is my ex's lawyer crooked I know! The DA is his uncle! We have to go through the DA to move to another court! HaHa and the DA wont approve the Jurisdiction! Go figure! So, I can either settle with Temp. custody or pay a new Lawyer out of N.O. 9k to file with the state DA to move the court. And then Pay her an additional 6k for the actual custody hearing!

JUST AN UPDATE...

Well... Court was scheduled for August 4th and once again has been continued thanks to my ex and his attorney... So now we are supposed to go October 18th... oiiii.... Please keep praying for us...

Are you scheduled with the same judge each time that it is postponed? I would hope the judge would realize that their attorney is doing this on purpose. The 6th admendment is about the right to a speedy trial for a criminal case. In civil cases it looks like any number of reasons could be used for a continuance but must be agreed to by the judge. What does your attorney say about this? Nothing he can do?

Yes, it is with the same judge... I could always ask for a different one but that would cause more harm then good. My ex is trying to get 50/50 custody back and doesn't want to pay child support anymore. If I pursue trying to move he is trying to offer splitting the children and I will NOT accept that offer... I will not split up my kids. My attorney tried to fight it and say that we are ready but the judge decided that it was ok to continue again... I will be speaking to my attorney this week and hoping we can go a different direction...

your attorney should argue that this is nothing more than stalling, and due to this it is making it much harder on the children than what it should be. something along the lines of an ongoing custody battle is disruptive to their education as well as their general well being. If that can be proved, and the judge still wont hear the case. Then perhaps the problem runs deaper then what appears on the surface. If she agrees that more time is necessary after the 18th of october than i would make the argument for just that. No practicing lawer should ever take this much time in a custody battel; if the evedacne isnt there than it just isnt. Sorry to hear all this twilla, but you and kenny will pull through, and good things come to those that wait, so be patient and play their waiting game for the time being.

Because it's not called a custody battle for nothing, I offer a few quotes from the greatest general to ever live, and one of my favorite authors...
The general who wins a battle makes many calculations in his temple ere the battle is fought. The general who loses a battle makes but few calculations beforehand. Thus do many calculations lead to victory, and few calculations to defeat: how much more no calculation at all! It is by attention to this point that I can foresee who is likely to win or lose.




He will win who knows when to fight and when not to fight.

He will win who, prepared himself, waits to take the enemy unprepared.

The good fighters of old first put themselves beyond the possibility of defeat, and then waited for an opportunity of defeating the enemy. To secure ourselves against defeat lies in our own hands, but the opportunity of defeating the enemy is provided by the enemy himself.

The clever combatant imposes his will on the enemy, but does not allow the enemy's will to be imposed on him.

If we wish to fight, the enemy can be forced to an engagement even though he be sheltered behind a high rampart and a deep ditch.
